Draft Minutes Board of Civil Authority

CTO: 7:15 P.M.
ATTENDANCE: Appellant, Geraldine Gormley, Board members Bradley McVetty, Douglas Lord, Kyle Bouthillier, Gail Tattan-Giampaolo, Bruce Hobaugh, Susan Irwin, our head Lister Elaine Hodge, and visitors Guilbert and Nancy Desrochers, Guy Giampaolo and David Hodge.
Chairman Gail Tattan-Giampaolo called the meeting to order and the first order of business was to note that the meeting had not been properly warned. Geraldine Gormley expressed her desire to move forward with the meeting anyway.  It was noted that the clerk will research with Vermont League of Cities and Town’s to see if the meeting is legal or whether we need to hold another one.
Written notification of Mrs. Gormley’s appeal was presented to the Board of Civil Authority. This was in regards to her denial of the grievance she presented at the Grievance Day Appeal held on April 21, 2016 with respect to the “Change in Appraisal of Real Estate,” for her property identified as parcel 06-097-073.000.
Mrs. Gormley’s first concern was as follows: 1.  The claimed justification for it “ADD ATTACHED SHED ON GARAGE” is incorrect as no shed has been added on the property attached to the garage or otherwise.  Accordingly, there is no justification for the increase in assessment by $1,600.00 (One Thousand Six Hundred Dollars and No Cents) and the same should be reversed.
Mrs. Gormley informed the Board that the attached shed has been there since 2006 as evidenced by her building permit. This document was shared with the Board.  Her neighbor has a shed attached to his garage and his is valued at less. Her request is that her garage assessment to which the shed is attached should be brought to the same value as her neighbors. Her value is $26.54 per square foot and her neighbors is valued at $17.00 per square foot.
Guilbert Desrochers asked to speak and mentioned that Mrs. Gormley would have had no way to know that she wasn’t being taxed for her shed. 
Her second concern is as follows: 2.  All buildings on the Property remain as they have been since prior to its last assessment by the Town of Maidstone, with the exception of a deck that was removed from the Property, acknowledged by the Town of Maidstone to diminish the value of the Property by $1,346.00 (One Thousand Three Hundred Forty Six Dollars and No Cents).  Accordingly, the CIA should reflect a change in value from $289,500.00 (Two Hundred Eighty Nine Thousand Five Hundred Dollars and No Cents) to $288,154.00 (Two Hundred Eighty Eight Thousand One Hundred Fifty Four Dollars and No Cents) to take into account the acknowledged $3,346.00 (One Thousand Three Hundred Forty Six Dollars and No Cents) in diminished value.
The Clerk presented to the Board copies of Mrs. Gormley’s written notice dated September 15, 2015 informing the Town that the back deck had been removed and in its place are steps leading to the doorway. She also requested in the same letter that the valuation of $1,346 for the back deck be removed.
When asked why this had not been done, Lister Elaine Hodge said the Listers were asked not to go on the property. Mrs. Gormley stated that she knew listers could visit the property.  Elaine then presented a form with a notation stating that they were asked not to go on the property.
Mrs. Gormley asked if in the future there could be a better record of which properties were going to be visited when and by who. Elaine presented a document that showed which properties were visited but not when or by who. 
The Board then appointed a 3-person committee including Gail Tattan-Giampaolo, Douglas Lord and Bradley McVetty.  They are to meet Friday June 17th, 2016 at the Gormley property at 10:00 a.m. pending the decision as to the legality of the meeting by Vermont League of Cities and Towns.  Mrs. Gormley will meet the committee and the committee also asked Lister Elaine Hodge to accompany them.
ADJOURNMENT: Douglas moved to adjourn the meeting at 8:23 p.m. Kyle seconded the motion and the motion carried.
